    • Government’s attempt to scrap the by-elections of legislative Council

    News Content

    • After the Bar Association issued the fourth warning against the government’s bill to scrap the Legislature by-elections, the Secretary for Justice Wong yan-lung and Secretary for Constitutional Affairs Stephen lam Sui-lung made a legal defense on the revised proposal.
    • Wong insisted the revised proposal is in line with the Basic Law. Citing a Court of Final Appeal judgment, Wong insisted the government had the discretion to decide the method for filling the midterm vacancies in Legco.
    • Chief Executive Donald Tsang Yam-kuen defended the revised proposal, urging public to support it.
    • However, 13 pro-government and independent legislators said they were still undecided on which way to vote.

    Questions

    • By simply asserting government’s discretion to decide the method for filling midterm vacancies in legco, Secretary for Justice failed to safeguard the public interest. He has disappointed the Hong Kong people.
    • It is wrong for Chief Executive to defend the proposal. He should withdraw the proposal.

    • Secretary for Constitutional and Mainland Affairs Stephen Lam gave details of a revised proposal for filling vacancies in the legislative council after meeting the members of a bills committee yesterday.
    • According to the revised proposal, the next candidate on the same list as the legislator who resigns, dies or is disqualified during his four-year term will get the seat.
    • If that person is not willing to take or is no longer qualified, or if no one else is on the list, then the seat will go to the candidate next in line in terms of the number of ballots their slate received in the election.
    • A By-election will be held only if the vacancy still cannot be filled.
    • Lam said the revised proposal will be able to withstand court challenges.

    Questions

    • The revised proposal still deprives people of the right to vote and be voted.
    • Lam insisted no public consultation will be conducted.

    • Government’s proposal to scrap by-election for geographical constituency seat

    News Content

    • SCMP quoting a source close to Beijing’s liaison office reported today that the liaison office and the pro-establishment camp are pondering to two amendments of the government’s proposal to scrap the by-election for the geographical constituency in legislative Council.
    • Two reported amendments are: (1) allowing a midterm vacancy arising from death or serious illness to be filled by a by-election; (2) filling the vacancy with the next-in-line candidate on the same party’s list.
    • The DAB, pro-establishment party supported the second amendments. Professor Chen Hung-yee said the government should not ban by-elections called because a legislator dies or is seriously ill.
    • Secretary for Justice Wong Yan-lung yesterday defended the government’s proposal openly for the first time.

    Questions

    • The two reported amendments are ‘fake concessions’. It still deprives people of right to vote and being voted.
    • The pro-establishment camp has not made any real concession. They do not ask the government to commence a public consultation on the proposal.
    • Hong Kong people are comfortable with the liaison office’s suggestion, as it may violate the principle of one country two systems.

    • Three pregnant mainland women with Hong Kong husband knelt down in front of the Health minister’s car last sat to protest against his decision to deprive them of their rights to deliver in Hong Kong.
    • Secretary for Food and Health said maternity beds for non-local mothers at public hospital would be capped at 3,400 while 31,000 should be available at private hospitals. But mainland women married to Hong Kong men will not have the rights enjoyed by the local mothers though their baby will be a permanent resident in Hong Kong.
    • Executive Council convener Leung Chun-ying however said a separate set of quotas should be given to those mothers.

    Questions

    • Privatizing the public. Even worse, they are classified as the third class mother in their rights to deliver in Hong Kong. Money counts more.
    • It is expected more mainland women will risk giving birth in Hong Kong hospital emergency rooms.

    • Government’s attempt to scarp by-elections.

    News Content

    • The pan-democrats staged a walkout at a legislative Council committee yesterday after the motion to withdraw the bill which proposed to scrap the legCo by-elections was voted down by 13 votes to eight.
    • The pan-democratic said they protested against a legislative push by the government which showed little respect for public opinion. They later resigned from the bills committee, and called on public to make the issue the focus of the annual July 1 demonstration.
    • Cyd Ho, the Civic Act-up legislator criticized the government for its procedural violence, saying this is even worse than the legislative work on Article 23.

    Questions

    • Secretary for Constitutional and Mainland Affairs Stephen Lam is hasty to push forward the controversial bill, trying to complete the legislative process of the bill complete in 35 days, which is unprecedented.
    • The Bill has deprived the people’s right of electing and being elected in the legCo by-elections. It should be vetoed.
